Kenya Court Allows Challenge to Trillions in Public Debt

On June 25, 2026, a three-judge bench cleared the way for a full hearing on Omtatah's April 2025 case, which questions if loans from 2014/15 to 2024/25—labeled 'odious debt'—followed the Constitution and finance laws.

The ruling denied dismissal bids by the Attorney General and others but granted the IMF diplomatic immunity.

With debt at Sh12.83 trillion and nearly half the budget going to servicing, Omtatah called it a win for transparency, with the case set for July 22 filings ahead of merits arguments.
