Kenyan Court Upholds Constituency Results as Final for Elections

Justice Gregory Mutai dismissed petitions from Busia Senator Okiya Omtatah, Wiper leader Kalonzo Musyoka, and former Deputy President Rigathi Gachagua.

The decision confirms that constituency returning officers' declarations, based on polling station tallies, are binding, while the national tallying centre at Bomas of Kenya can only aggregate and verify them against the constitutional threshold of over half the votes plus 25 percent in more than half of the 47 counties.

Lawyer Eric Muriuki highlighted that this preserves the IEBC's role in tallying without allowing alterations, potentially speeding up results for the 2027 election but increasing pressure on local accuracy. A parliamentary bill may soon propose further changes, like eliminating the national centre.
